Terms & Conditions

These terms of intermediation govern the contractual relationship between you as guest (hereinafter the „Client“) and Balearian Hospitality Services S.L., Carrer d'Alber 64, 07008 Palma de Mallorca, Spanien, CIF/NIF: B26863035, info@thebalearian.com (hereinafter „The Balearian“).

1. The Role of The Balearian

The Balearian acts exclusively as an intermediary and is neither a tour operator nor a landlord. The rental agreement is always concluded directly between you and the respective owner of the accommodation.

2. Booking & Conclusion of Contract

With your booking you submit, through The Balearian, a binding offer to the owner to conclude a rental agreement. The rental agreement is concluded upon booking confirmation by The Balearian.

3. Payment Terms

For direct bookings the following applies: a 50% deposit of the rental price upon booking confirmation, with the balance due no later than 60 days before arrival. For bookings made through affiliated portals, their payment terms apply in addition.

4. Security Deposit & Damages

A security deposit may be levied for direct bookings. It is generally refunded within 14 days of departure, less any substantiated damages.

5. Withdrawal & Cancellation Terms

For direct bookings, cancellations are subject to the following scale, calculated on the rental price:

• Cancellation 60 days or more before arrival: 59 % of the rental price
• 30–59 days before arrival: 50 % of the rental price
• Fewer than 30 days before arrival, no-show or early departure: 100 % of the rental price

6. Services, Defects & Liability

The Balearian is liable solely for the proper intermediation, but not for the provision or quality of the accommodation service itself.

7. Concierge Services & Additional Services

The contract for additional services is concluded directly between you and the respective service provider. The Balearian assumes no liability for the services of third parties.

8. Data Protection

Balearian Hospitality Services S.L. processes personal data exclusively for the handling of your booking and in accordance with the General Data Protection Regulation (GDPR). Full details may be found in our Privacy Policy.

9. Accommodation Details / Liability for Content

Images, descriptions, amenities and technical installations do not constitute warranted characteristics unless expressly confirmed in writing.

10. Applicable Law & Place of Jurisdiction

Spanish law applies exclusively. Insofar as legally permissible, Palma de Mallorca is agreed as the place of jurisdiction.

11. Supplementary Spanish Legal Clause

The mandatory provisions of Spanish consumer protection law apply in addition. The statutory place of jurisdiction remains applicable for consumers.
